The Act:

Every child in the age group of 6-14 years will

be provided 8 years of elementary education.

Any cost that prevents a child from accessing school will be borne by the State.

No child shall be denied admission for want of documents.

IMPLEMENTATION OF ACT :
Under the 86th constitutional amendment ,2002 right

of children to free and compulsory education act ,2009 in the Article 21-A of the Indian constitution inserted RTE as one of the fundamental right by special majority of both the houses of parliament. The act came into force from 1st april 2010. Prime Minister Manmohan Singh announced the operationalisation of the Act. Children, who had either dropped out of schools or never been to any educational institution, will get elementary education.

Main features of Right to Education Act :
Free and compulsory

education to all children of India in the six to 14 age group.
No child shall be held back, expelled, or required to pass a board examination until completion of elementary education.
A child who completes elementary education shall be awarded a certificate.
Calls for a fixed student-teacher ratio.
Will apply to all of India except Jammu and Kashmir.

Provides for 25 percent reservation for economically disadvantaged communities in admission

to Class One in all private schools.
Mandates School teachers will need adequate professional degree within five years or else will lose Job.
School infrastructure (where there is problem) to be improved in three years, else recognition cancelled.
Financial burden will be shared between state and central government.

Right To Education Bill :
The Right of Children to Free and

Compulsory Education (Amendment) Bill, 2010 was introduced in the Rajya Sabha on April 1st, 2010.  The Bill was referred to the Standing Committee on Human Resource Development, which is scheduled to submit its report within two months.

The Bill amends the Right of Children to Free and Compulsory Education Act,2009.  It expands the definition of “child belonging to disadvantaged group” to include children with disability.  .  “Child with disability” is defined as a child who is blind, leprosy cured, hearing impaired and mentally ill. .  It also includes children suffering from autism, cerebral palsy, mental retardation and multiple disabilities.

A child suffering from autism, cerebral palsy, mental retardation and multiple

disabilities has the same right to pursue free and compulsory elementary education which children with disability have under the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995.
The Act provides for establishing School Management Committees to prepare school development plan.  Article 30 of the Constitution provides that all minorities, whether based on religion or language, shall have the right to establish and administer educational institutions of their choice.  Thus, the Bill states that School Management Committees of minority institutions shall function only in an advisory capacity.
